Haim Boukris, a 29-year-old haredi rabbinical student and teacher, was acquitted on child sex abuse charges today in Sullivan County, New York, the Times herald-Record reported.
Boukris was accused of sexually assaulting an 11-year-old boy in 2011.
At his bench trial today, Sullivan County Court Judge Frank LaBuda dismissed the charges of predatory sexual assault against a child and first degree sexual abuse, which are both felonies, due to what he found to be confusing and insufficient evidence.
“The decision is not based on the credibility of the young man or any witness,” Judge LaBuda said. “It's because the court was not able to find the innocence or guilt of the defendant.”
To justify that ruling, LaBuda pointed out the prosecution did not prove the exact date or location where the sex abuse allegedly occurred.
