That’s what Sullivan County, New York Judge Stephan Schick said today when he dismissed a lawsuit filed by the Town of Mamakating against Village of Bloomingburg and its building inspector Joseph W. Smith, Sr., the Times Herald-Record reported.
Mamakating alleged that Smith acted inappropriately when he issued certificates of occupancy for the first 24 units of a total of 396 units in Chestnut Ridge, the controversial – and, many say, illegal – high-density housing development erected by Modern Orthodox developer Shalom Lamm.
Chestnut Ridge was marketed in Yiddish as a new Satmar hasidic shtetl named Kiryas Yetev Lev but was originally pitched to Bloomingburg and Mamakating as a low-density golf course community complete with a 9-hole golf course.
In this latest lawsuit, Mamakating alleged Lamm’s construction violated the state fire code and other regulations, lacked a proper well easement, and did not have Public Service Commission approval.
After two days of testimony, Schick said Mamakating failed to prove its allegations and dismissed the case.
