Australian Police will not investigate members of the Adass Israel girls school's board over their roles in helping accused serial child sex abuser Malka Leifer flee to Israel to avoid police investigators, despite the fact that their actions were likely criminal in intent.

Australian Police will not investigate members of the Adass Israel girls school's board over their roles in helping accused serial child sex abuser Malka Leifer flee to Israel to avoid police investigators, the Australian reported.
The decision not to investigate the board was made in spite of legal experts opinions that the board members’ behavior was clearly criminal.
But police confirmed they had not and would not investigate those board members even though a judge in a civil suit recently found those board members helped Leifer flee to avoid an investigation.
Rob Melasecca, a former head of the criminal law section of the Victorian [Melbourne] Law Institute and a noted expert on criminal law said that at “a bare minimum” the actions of individual board members in helping Leifer flee “warranted a serious [police] investigation” and noted that individuals who help a person escape a police investigation and potential prosecution are “without doubt” an accessory to a crime and “conspirator[s],” and if they were actively aware that a crime had been committed but still helped the criminal flee, then they were also guilty of “perverting the course of justice.”
“Each and every one of these crimes depend on a prosecution being about to prove knowledge of the crime and they need to prove the individuals involved in helping the perpetrator escape justice were aware of the consequences of their actions — in other words, they were aware that person had committed a crime and were helping that person avoid prosecution. If you assist a person escape prosecution you are without a doubt an accessory to the crime,” Melasecca reportedly said.
A civil judge has already found that foreknowledge and intent was present for at least some of the board members when they helped Leifer flee to Israel in the middle of the night.
Leifer, who was principal at the Adass Israel girls school in Melbourne, allegedly sexually abused more than eight teen students. She is living in the West Bank haredi settlement of Immanuel where she is on house arrest while fighting extradition to Australia.
