A married Brooklyn prosecutor – the son of an Orthodox Jew who served as a liaison between his boss, Brooklyn District Attorney Charles J. Hynes, and the haredi community – was caught by another prosecutor calling outcall prostitutes from his office phone, The New York Post reported.
Mark Posner, a 37-year-old who worked under scandal plagued Hynes aide Michael Vecchione in the DA’s Rackets Bureau, was quietly transferred to a low profile post, but he was not investigated, prosecuted or fired.
Posner’s father was Charles Posner, an Orthodox Jew who was a judge who had also served as a top aide to Hynes and his liaison to the haredi and Orthodox communities.
Mark Posner was caught by Lauren Hersh, the former head of the DA’s Sex-Trafficking unit, when she noticed his office number in a log of incoming calls to a prostitution service during a sex trafficking investigation in 2009.
Why wasn’t Mark Posner fired?
“He’s Charlie’s kid, first of all…They don’t want to anger the [Orthodox] community by firing Charlie’s kid,” a source told the Post.
Hynes office, used to doing damage control as the more and more misbehavior of its prosecutors is made public, denied any wrongdoing.
“As soon as we learned of this conduct by ADA Mark Posner, District Attorney Charles Hynes immediately suspended him for 10 days without pay, ordered him to seek counseling and transferred him to ECAB,” Hynes’ spokesman Jerry Schmetterer reportedly told the paper.
When the Post asked why Posner was moved to a less prestigious post instead of fired, Schmetterer declined answer.
So much for Hynes’ damage control.
The rackets prosecutor who discovered Posner’s calls was Lauren Hersh, the former head of the DA’s sex-trafficking unit who resigned last year after a sensational Crown Heights rape and forced prostitution case unraveled, a law-enforcement source told the Post.
