A New York State lower court judge has denied a motion for a preliminary injunction to stop the construction of a controversial water pipeline connecting the Satmar hasidic village of Kiryas Joel to New York City’s Catskill Aqueduct, the MidHudson News reported today.
The Town and Village of Woodbury and Village of Harriman wanted the preliminary injunction to stop construction while their legal challenge to Kiryas Joel’s pipeline winds it way through the court.
The pipeline has been widely decried for its negative environmental impact and for the extreme pressure it will put on the water supply of nearby towns. Much of the pipeline has been constructed without all the necessary studies and permits being in place.
Justice Francis Nicolai ruled that because the original petition did not ask for the pipeline’s construction to be immediately halted, he would not agree to issue a a preliminary injunction now.
“[The] original petition did not seek any relief in connection with the construction of the water supply pipeline, and this the Court adheres to its initial determination denying a preliminary injunction to halt construction of the pipeline,” Nicolai reportedly wrote.
A previous request for a temporary restraining order had already been rejected by the court.
