A Monsey haredi Level 2 sex offender has reportedly been arrested and jailed after he violated conditions of his probation – probation he was sentenced to earlier this year in lieu of a prison sentence.
According to a report in the Journal News, 33-year-old Shmuel Dym violated eight conditions of that probation, law enforcement officials allege, including refusing to attend sex offender treatment and violating curfew.
Dym admitted in court that he fondled an 8-year-old boy multiple times between May 2010 and July 2011, and did the same with a 6-year-old boy between September 2010 and July 2011.
He pleaded guilty in June 2012 to two counts of second-degree course of sexual conduct against a child – a felony – and two counts of endangering the welfare of a child, which is a misdemeanor.
But Dym later tried to withdraw his guilty plea, insisted he was innocent and fired his attorneys.
State Supreme Court Justice William Kelly ruled that Dym could not withdraw his guilty plea because Dym understood his rights when he made the plea and did not plead guilty under duress.
The two felony counts could put Dym in prison for 14 years if he is found to have violated probation, Patricia Gunning, a county prosecutor, told the Journal News.
Dym was offered a no-jail sentence by the prosecution after the children’s family were threatened and harassed by hasidim in a successful attempt to dissuade the boys’ parents from allowing them to testify against Dymn in court, a fact that prosecutors openly admit – even though they have done nothing to bring the hasidim who made those threats to justice.
Dymn was arrested on the probation violations Friday and will not be released until he posts a $100,000 bond (or $50,000 in cash), or is found not to have violated probation.
Dym’s younger brother Betzalel is also a Level 2 sex offender. He was convicted in August 2006 of first-degree sex abuse of a 10-year-old boy. He had sex with boy five times between January and May 2006.
Betzalel Dym later was a party in a lawsuit heard by Kelly, who ruled that a Rockland County a county law mandating where sex offenders can and cannot live and can and cannot congregate was unconstitutional.
