Former Sefardi Chief Rabbi Eliyahu Bakshi-Doron has issued a new halakhic ruling that is likely to be controversial.
In response to a question from the Puah Institute, Ynet reports Bakshi-Doron ruled that a life-saving organ donation can be taken from a donor with HIV, even if the recipient may contract HIV from the transplanted organ.
The logic behind the ruling appears to be that without the transplant the recipient would surely die, but HIV is now a manageable infection and people can live for many years with it, as long as they take the correct anti-viral cocktail of drugs.
Bakshi-Doron is currently on trial in a highly publicized unrelated fraud case.
