Rabbi Tzvi Flaum, when told that the entire supposition that allows Jews to take organs removed from brain stem dead patients is false, says "then we got a problem."
The question being discussed is a s follows: If brain stem death is not death under Jewish law, and if removing organs from a brain stem dead patient is murder under Jewish law, then how can Jews receive organs removed from brain stem dead patients?
Flaum and other leaders of the Rabbinical Council of America now say they believe brain stem death is not death under Jewish law, and that removing organs from a brain stem dead patient is murder under Jewish law, but they allow Jews to receive organs removed from brain stem dead patients.
In the above video, shot a couple years ago, Rabbi Flaum admits that position is problematic.
Nevertheless, in the past few months the RCA changed its position approving brain stem death as death under Jewish law, said removing organs from a brain stem dead patient is murder – but still allows Jews to receive organs removed from brain stem dead patients.
