The Manhattan federal judge, John Koeltl, was baised, the plaintiffs in the Yeshiva University sex abuse case claim.

Koeltl “assumed the role” of a defense attorney by “concocting” an argument YU's actual attorneys never made, the plaintiffs say in their appeal brief, the New York Daily News reported.

Koeltl dismissed the case against YU because the statute of limitations to bring it had long elapsed and becuase the plaintiffs would’ve known that decades ago if they had either reported the crimes to police or sought legal advice to civilly sue YU when the alleged abuse actually took place.

The alleged victims were teenagers when they were allegedly abused at YU's affiliated high school in Manhattan.

They sued the school for $680 million.

Is there a link to the actual argument that the YU lawyer "never made"?
Also, do judges really solely rely on arguments the lawyers make and not on their knowledge of the statutes and precedents? Wasn't this case a really long shot to begin with?

Long shot?

Yes and no.

The suit was that the cover up was discovered now and thus the statute of limitations clock just started to run.

We weren't suing for being abused per say , but rather there was a conspiracy to cover up the abuse that was only discovered recently.and we were in court to be compensated for the organizational cover up of our abuse.

That was the way around a direction because we were abused.

Rabbi Blau and others out there still know of abusers out there that they won't talk about or identify.

Anyone who doesn't report abuse is as culpable as the abuser. This "let's stand together" mentality gives these guys a free pass. When the epidemic proportions of molestation in the frum community become publically known, it will make the Catholic church look like small stuff.... A university that covers abuse should lose its right to be called a university. Shame on them... They are an embarassment to all Jews observant or not.
