On Wednesday, a New York State judge ruled that the state’s Education Commissioner, John King, acted correctly when he voided a rental agreement of an East Ramapo public school building to a New Square hasidic group at below market rate, the Journal News reported.
“In sum, this court finds that the Commissioner’s determination was wholly rational and was not arbitrary and capricious or affected by an error of law,” Acting Supreme Court Justice Roger McDonough wrote.
King’s July 2013 decision said that the haredi-controlled scandal-plagued school district gave Congregation Avir Yakov a sweetheart lease on the former Hillcrest Elementary School that was well below market-rate rent.
The hasidic group was paying $21,000 per month rent and was getting other considerations from the district as part of the deal.
The court’s action should mean the lease nullification will go into effect as soon as the the paperwork is completed.
Avir Yakov has been using the former Hillcrest building since August 2011.
The haredi-controlled school district closed the Hillcrest School shortly before that, claiming that public school enrollment was declining.
But it wasn’t.
East Ramapo’s public school population has increased, not declined. But the public school budget has been deeply slashed due to pressure from large haredi voting blocs that have repeatedly voted against any tax increases to fund public schools and through haredi control over the school board itself.
East Ramapo’s attorneys reportedly claimed that voiding Avir Yaakov’s lease and the lost rental income which would ensue would force the school district to fire public school teachers and cut back services even further. lawyers have said cancellation of the lease would cause “irreparable harm” to the district, forcing it to fire teachers and cut educational programs to make up for lost rental revenue and increased building maintenance costs.
The school district is now trying to sell the former Hillcrest School.

All I ever hear in shul is how the Hungarians are going to win this case, that case, etc. etc. After they lose, well, "I never said that." As Zeresh said to Haman, "when they fall, they continue to fall." Nothing here on the Hungarian side is Torah driven; it is all Torah destroying. Everything is a calculation of how far they can push the legal line and still live in a way that is a corruption of a decent non-Jewish society among which we all live. Sooner or later the corrupt leaders are going to realize (hopefully) that education and other reasonable parts of American society will need to be included in their approach, simply just to survive. The article in the NYT about the lower sales at Walmart due in part to a lowering of Foodstamp availability is telling.

There is seemingly no end to the lengths this derelict BOE will stoop to to waste every tax dollar that should be going to the classrooms of poor children of color. If Shmarya Hater is Daniel B Schwartz, Esq. and former President of the Board when this lawsuit was launched against NYS, he should be hanging his head in shame. DBSesq is named in a Federal lawsuit alleging discrimination, NYSED was victorious over the lawsuit DBSesq launched and was found to be presiding over discriminatory placements for white, Orthodox kids special Ed students, while he cut special Ed services for public school special Ed students. Now, the State is crawling all over ERCSD to try to fix what he helped destroy. Now, in this case, DBSesq lost again trying to give a school to his friends. Maybe DBSesq should be concerned about what the 2/10/14 court date with the fraudulent Appraiser will say in order to plead out for a lesser sentence. And the icing on the cake is that the AG is still sniffing around about this deal which could be considered a gift of public funds to Avir Yacov. Just think, it was just about this time that DBSesq had to resign because 2 long term Trustees resigned their positions on the board citing intimidation, harassment and threats! Whoa! And being both a lawyer and President of the board while that happened? Never did DBSesq ever deny that it happened under his watch. Yeah...Maybe his time would be better spent praying to the Almighty that his license isn't yanked! Boy his boss, Barry Kantrowitz, now Legislator Kanntrowitz won't be pleased if the firm's name gets dragged through the mud that Danny contributed to.
To sum it up, three major losses in a row for the losers on the Board!
