A U.S. Court of Appeals has upheld the almost 4-year long sentence of a haredi rabbi convicted of laundering nearly $1 million through religious charities, the AP reported.
Rabbi Mordchai Fish is one of five haredi rabbis caught in a 2009 sting who pleaded guilty to laundering money through religious charities and Israeli organizations for government informant Solomon Dwek.
Fish, who headed Congregation Sheves Achim in Brooklyn, took checks from Dwek and laundered them through a religious charity he controlled, giving Dwek 90% of the checks’ value in cash and keeping 10% percent for himself.
Fish pleaded guilty but was not sentenced until last year. His lawyers appealed that sentence, arguing that Fish’s crimes weren't "sophisticated" and therefore did not warrant a sentencing enhancement.
The 3rd Circuit of the United States Court of Appeals disagreed, ruling today that U.S. District Court Judge Joel Pisano's sentence of Fish was within his discretion and properly reflected the facts of the case.
The basic argument of "my client is stupid", while perhaps true, never seemed to me to be a winning strategy.
