Monsey haredi pedophile Shumel Dym, who was originally given a 10-year no-jail probation-only sentence for sexually abusing two haredi children, was sentenced to six months in the county jail last week for violating it, the Journal News reported.
Dym refused to attend mandatory sex offender remediation classes or comply with the other conditions of his probation.
Dym was offered the no-jail sentence by the
prosecution after the children’s family were threatened and harassed by
hasidim in a successful attempt to dissuade the boys’ parents from
allowing them to testify against Dymn in court, a fact that prosecutors
openly admit – even though they have done nothing to bring the hasidim
who made those threats to justice.
Dym was classified as a Level 2 sex offender after he admitted in court before Judge William Kelly that he molested an 8-year-old boy and a 6-year-old boy.
Dym later asked Kelly to withdraw that guilty plea, but the judge refused, and warned Dym that he would be sent to state prison if he violated the terms of the probation-only sentence.
Dym, who is appealing that decision, was sentenced to six months in the much nicer Rockland County jail instead.

At least he will be off the streets for 6 months...and when he gets out, will reoffend.

I assume he is already complaining that the food is not kosher enough.

The failure of the justice system in Rockland County is spectacular. Not to prosecute for intimidation is inexcusable. The entire legal establishment is falling down on its job of protecting children. Rockland used to be a nice place with normal people living there; they're being driven away by these Haredim.

Legal question for somebody knowledgeable to please answer.
If somebody is given a probationary sentence and violates it, does he go to prison for the full term? For example, if Dym violated the terms of his 10 year probation, should he go to prison for 10 years?

@Bas- I think that depends on both the Judge, and the state sentencing statutes in whatever state we are discussing. I have no experience, vis-vis New York State.
I know in Utah, where I used to practice, a Judge could 1) revoke probation and reinstate it (meaning the time you had already spent on probation was down the drain), but I only saw that happen on non-serious probation violations- failure to maintain employment, or meet with the parole officer, or something like that.
I'm going to assume that a Judge in NY State (and most states, for that matter) can either do the same, OR send the person to prison for part of the term, OR, send the person to prison for the full term. I think it will depend upon the nature and severity of the probation violation, and how many times the terms and conditions of probation have been violated.
@SML- I completely agree. For someone like this person to get a probation-only sentence? It sends ENTIRELY the wrong message to the public that message being "You molest children- you don't do time".
As a citizen, I am shocked and repulsed. As a (former) Criminal Defense Lawyer, that is a result you can't beat with a stick. But as an Uncle, if my niece and nephews were living in that area, I'd move heaven and earth to get them out of there.

I think I've seen Shmuel Dym someplace else. I believe it was in the "Early Man" exhibit at the Field Museum of Natural History in Chicago.
