Chabad Continues To Harass Abuse Victim's Family, Stalls Government Dispute Resolution

Chabad Yeshiva College MelbourneChabad in Melbourne continues to harass and shun Zephania Waks for supporting his son Manny's campaign to bring Chabad (and other) pedophiles to justice. At the same time, it blocked attempts by Zephania Waks to resolve the shunning case in beit din and now is stalling an attempt to have the shunning case heard by the Dispute Resolution Unit of the Victorian Equal Opportunity and Human Rights Commission.

As I told you, these delaying and other tactics by the Respondents are unacceptable.
 
Since I initiated the complaint with you, I have agreed to all their demands for the benefit of the conciliation, by my actions, not words, by:
    1.    waiting for the conciliation meeting, without good reason, till after the recent Festival rather than earlier as I requested;
    2.    agreeing to confidentiality during the conciliation, against my will, because otherwise they would not attend;
    3.    giving them another chance after they cancelled the conciliation just 4 days before the agreed date, for no good reason;
    4.    accepting, twice, most recently yesterday, their unwillingness to show the smallest gesture of goodwill towards the conciliation by giving me an aliya upon the birth of a grand-child, as is customary for everyone else in the congregation.
In my view, despite their words to you that they really want to conciliate and sort out the matter, it’s just that: words. I am not prepared to play their games any more.
 
As far as the Victorian Equal Opportunity and Human Rights Commission is concerned, what do I have to do in relation to my complaint to move to the next step, which I believe is VCAT?
 
I am very sorry it’s come to this, though, as you know, I am not surprised.

Here is what the VCAT does:

A Supreme Court judge heads VCAT as President. County Court judges serve as Vice Presidents. Applications are heard and determined by Deputy Presidents (appointed on a full time basis), Senior Members and ordinary Members (may be appointed on a full time, part time or sessional basis).

Members have a broad range of specialised skills and qualifications, enabling VCAT to hear and determine cases of varying complexity and subject matter.
What we do

Since its inception, VCAT’s purpose has been to provide Victorians with a low cost,accessible, efficient and independent tribunal delivering high quality dispute resolution.…

VCAT now comprises three divisions.…

The Human Rights Division deals with matters relating to:

    guardianship and administration
    discrimination
    racial and religious vilification
    health and information privacy, and
    decisions made by the Mental Health Review Board.

Appeals of VCAT decisions go directly to the Supreme Court.

Jack - it's their shul. They were there before these Chabadnicks - they will be there after they've been run out of town.

And they will be.

I admire their tenacity - and truly believe in the long run that it will pay off - the pendulum WILL swing.
