• The plea is to one count of conspiracy

• The sentence is left up to the judge and can range anywhere from 0 to 300 months in federal prison

My information comes from a source close to the case.

There's nothing on Pacer about the hearing or the plea, and the court is not allowed to confirm or deny that a plea is scheduled to be entered this afternoon.

But a source in the courthouse was able to tell me that it would be worth my while to rush over there, which essentially confirms that a plea hearing will be held in just over one hour.

Update 1:42 pm CST – another source very close to the case tells me the plea went as follows:

• One count of wire fraud

• One count of money laundering

• Wire fraud carries a sentence of up to 20 years in prison.

• Money laundering carries a sentence of up to 10 years in prison.

• He faces 0 to 300 months on all the charges combined.

• Sentencing is scheduled for April 2.

• The judge plans on seizing all of Weinstein's assets to use for restitution.

Update 2:52 am CST 1-4-2013 – According to the APP, the actual charges are:

• One count of wire fraud conspiracy

• One count of money laundering

• About three dozen other charges were dropped (which is obvious if you look at previous posts on Weinstein's frauds)

• The possible sentence is 0 to 300 months (i.e., up to 25 years) with as much as three years of supervised release.

Additionally:

• Weinstein must provide a full accounting of all monies paid to him during the period covered by the Indictment against him.

• Weinstein has also agreed to forfeit $2 million in property that has already been seized by the government and to pay restitution to his victims.

This is just the tip of the iceberg. Weinstrin probably stole around $500 million dollars. A substantial amount is sitting in Israel, Europe and with Lakewood charaties. My issues were not even include in the governments case. There are Approximately $188 million in redcoreded judgements against Weinstein. Yes,I claim he stole $80 million plus minus from me. But it was from the peopk=le that he stole uuch less from BUT wiped them out that are forever hurt.
Let's see if he turns over any more assets.

I'm not sure that it can be 0-300 months. Maybe 1 day to 300 months. Not that it really makes a difference. If he was cooperating and helped the investigation he's probably looking at 150-200 months (if the 300 months is a guideline figure). Of course there is no way to really know that without seeing the plea agreement, knowing what the guidelines are and what the govt will be pushing for at sentencing. If there are ongoing investigations that he is cooperating with, his sentencing can be delayed for years.

The Feds will pretend it was scheduled for the last day of pesach by mistake and adjourn the sentencing on that basis. But it was actually put on that day on purpose so they can delay his time in prison as long as possible. Do you actually believe that the feds need to schedule a hearing on a Jewish holiday and pretend it was a mistake in order to get the date continued!? First off the court schedules the next available date not the prosecution/feds. The first date is very often continued by the court at the request of the feds or the defendant for many possible reasons. If the Feds want to continue the case for extended periods and the defendant is cooperating, they simply need to file a Motion and the court will grant it. Your premise that the Feds need a trick to get the date continued is simply ludicrous.
