Sholom Rubashkin

"Eisov" is Eiasv or Easau, the biblical brother of and enemy of Yaakov, Jacob. Jacob is the father of all Jews. Eisav is the father of Edom and other non-Jewish enemies of the Jewish people, including Rome. Rabbinic thought views European powers and America as descendants of Eisav.

"Mishpat" in this context means justice.

"Yeshua" means salvation.

"Keli" means vessel.

So what Rubashkin is saying is that it was wrong to think that there could be any type of justice for a Jew that comes from non-Jews, especially American courts.

Justice only comes from God, and God will prove that by releasing Sholom Rubashkin from prison and getting him back to his family for Rosh HaShana, the Jewish New Year, that begins Wednesday night, September 28. 2011.

Note that this letter was written to his children and released by his family.

Also note that Sholom Rubashkin still shows no remorse for his crimes, admits no guilt, and views his incarceration as a form of antisemitism.

We are going to make the Miracle happen and reveal itself when we say and know GAM ZU LETOIVO, and WE DO NOT CHANGE IN OUR AVOIDAS HASHEM. We show that we know that HASHEM is doing this and that its GOOD and this will bring out the good.

My original post was just to point out, using Augustine, that people can take anything from the Bible and twist it to their own agenda. Just as Augustine's comment about who descended from Esav and Yaakov was self-serving, so too is the Jewish approach to Esav and Ya'akov. I'm sure that Islam has a similar teaching.

When SMR comes up for a re-trial eventually, I think the prosecutors should offer a very reduced sentence (< 5 years) conditioned on his making whole all of Agri's creditors. Hey - how about us FM readers have an "SMR Letter-Writing-Campaign". Every week another one of us is responsible for writing a letter to SMR in jail, and every week Shmarya will post our letters. At the end of the year, or after everyone is done posting their letters (and mailing them!) we can vote for whose letter was the best. Then we can send the voting results to Rubashkin, and ask HIM to vote and let us know which letter he thought was the best.

The point of course is to write some "reality check" letters to Rubashkin in jail to help him with this delusion of grandeur problem he's having.

And who knows, maybe one day he'll actually "see the light" and realize that he actually DID something wrong and apologize to everyone he hurt and pay everyone back and then get a "get out of jail free" card. Then, he can thank all of us for sending him the letters which helped him realize the folly of his ways and saved him from spending the remainder of his years in jail.

Question for all you lawyers out there: What is the procedure now if Rubashkin/Lewin want to take it further? How does it work? Anyone who thinks they didn't get a fair trial can just go ahead and take it to the Supreme Court? Is there a hierarchy of types of cases? Is there a waiting period? And doesn't the Supreme Court only hear cases in which questions of Federal law or the Constitution come into play? (Or are those the only ones I hear about?) Or is the Supreme Court a kind of second appelate court after the appelate court rules against you?

SMR has 90 days (yes I know I am simplifying this) to file a petititon for cert. Unlike the appeal to the Eighth Circuit there is no right to have one's case heard by the Supreme Court (in this case).

In genreral Lewin would have to convince 4 of the 9 justices that:

1. There is a difference of opinion among the 11 courts of appeal on an issue in Rubashkin's case and that the Supreme Court should decide which position is correct or

2.There is an important federal question.

Let's say Lewin can find a cases similar to SMR's in four or five circuits involving the recusal issue and that the Circuits have used different standards or that they ruled differently on the sentencing issue. In that case he might have a shot.

For instance, most Court watchers expect the Court to take a case involving Obamacare because it looks like the lower courts are split and its an important issue. Because fewer than 2% of petititons for cert are granted its unlikley that any run of the mill case is going to be heard and my unexpert opinion is that there is no crisp clean issue of law which needs to be resolved here. However, Lewin is a good lawyer and may be able to find a way.

Again I suspect some persistant pardon lobbying over the ensuing years.

Anyway, it doesn't sound like his legal options are very bright or hopeful, short of getting a pardon from a president on his way out of office.

The court punishment has a duel purpose: First to punish the wrong doer, and second; to deter others from committing similar or the same crime.

Others here have eloquently addressed the issue of the length of sentence - something you seem to reject. And one could argue that given the "holier than thou" attitude of the frum community the likelihood of deterrence is small at best. But it is the only tool available to a just and fair society which wants to protect itself from such thieves.

And yet millions were raised for Nat Lewin et cie, and I'm expected to work for free. Why? Perhaps next time someone calls me about such a case, I'll tell them to have Pinny Lipschitz raise the money for my fees, then we can talk. That's about how disgusted I am with all this Rubashkin nonsense. Why should I continue to care about an Orthodox world whose priorities are so out of sync of with the basic notion of "Kedoshim tihiyu?" It is too late for that, the system is setup that a defendant agrees to help and cooperate with the investigation, before the cop a plea. As both sides sign the deal, he will cop a plea before the judge, and the sentence will be handed down after he assists with the prosecution. Now it is all over.
