Flaum Appetizing Tries To Cheat Workers – Again
Flaum Appetizing, the hasidic-owned Brooklyn-based kosher food manufacturer and distributor that distributes Tnuva products in the US, has long history of cheating its immigrant workforce. Now workers allege that a Flaum attorney tricked them into signing a document voiding claims to hundreds of thousands of dollars in stolen overtime pay, and that he did so without first speaking to the workers' attorney, which is a serious ethical violation that could (and probably should) lead to censure and perhaps disbarment.

The only way, this economy is going to re-awaken, is, when we totally dismantle the, Dept of Labor, Workers Comp Board, Unions, Fed & State Unemployment, OSHA, and all other massisive regulations placed on every POTENTIAL employer.
Right now, people dont have jobs and everything is imported from China, even decorations for Succos.

We absolutely must protect our workers. Would you like them to be treated the way Rubashkin treated his employees? Sexual abuse, working with dangerous chemicals without protection, not getting paid standard wages, getting injured on the job and then being fired?

With these (goody goody) regulations currently in place, Mayor Bloomberg is nervous that jobless people are going to riot on the streets.
FACT: Just like can't bring your grandparents with you, to the factory you work in, to make sure they're treating you nicely, so too, you can not bring this Huge Beaurocratic Gov't into the factory.
Thousands of factories have closed down, and young people going into business are scared to hire workers, so they import from China.

If, as I fully expect, the facts alleged in this Memorandum are established by appropriate evidence then Jeffrey Meyer (the attorney for Flaum) will likely be in serious trouble.
This case is so egregious that it is actually a benefit for the plaintiffs.

Well not exactly...
The Free Trade Agreements meant that business owners can set factories up in foreign lands and send goods to the USA without duties and the such. Even hi priced/ hi quality industrial goods are being made in China. Don't have to worry about the EPA or anything--just employ the son or son-in-law of some secret police chief with a hard currency paycheck and one is good to go.
The major export of the USA are jobs

What is truly amazing is that the greatest beneficiaries of minimum wage, social security, medicaid, medicare, food stamps etc., are the haredim who rail against the democratic party and those people who created these programs. Unions protect workers from arbitrary dismissal and insure a decent pension benefit - what a radical idea. So radical that rudimentary unions existed among craftsman during the Temple period. What an anti-Jewish concept.
What is amazing is that Tnuva could never get away with this in Israel - the Histadrut would close these idiots down in a heart beat. Maybe we should ask Ofer Eini at the Histadrut to call a strike against Tnuva because of the actions of the ganufs at Flaum. Its time for people to realize that anything coming out of Flaum is trief.

A few comments from another lawyer.
This is a well-written brief. It says something if your ONLY criticism is that you believe a colleague should have used paragraph numbers.
The allegations against the defendants' attorney are, frankly, frightening. If these statements are true then it is surely a ticket to an appearance before the Grievance Committee. My own personal opinion, again, if these allegations are true, is that such conduct merits disbarment, if not worse.
Finally, since I don't practice labor law, the claim that employees who work more than a "spread of hours" exceeding 10 in any given day are entitled to one hour's minimum wage, came as a revelation. 12 NYCRR 142-2.4 I can only wonder how many companies are breaking this rule.

You can not Create jobs in a society that is so Anti-Employer.
Hiring workers in the USA is a losing activity. Even if importing from abroad will require constant travel, the headaches are still far less than hiring domestic employees with all these regulations.

Business is much smoother, importing from abroad, then dealing with US worker laws, hispanic illegal migrants go back to your country of origin.....be treated like deserved and give americans their jobs.....
I rather travel 24 times a year over 5000 miles each way, then dealing with this crap, and union and osha....

I dont know of any normal business man who recently decided to open up a factory to give jobs to American workers. They know that they'll wind up being chaged with something.
Labor lawyers that represent Employers are extremely expensive. And you'll need them.

If your business plan for success is based on paying your workers less then a living wage, then you have a failed business waiting to go under.
Stupid laws and regulations should be eliminated. OTOH laws designed to protect the public, are in the public's interest (see the elimination of lead in house paint which was vehemently opposed by industry as too expensive).
Flaum management either doesn't know how to make a profit, or are a bunch of greedy SOB's. Either way, they're trief.

yeah Flaums is the Argiprocessors of appetizing.
Don't buy Flaums, Schwartz's is a better Herring anyway. Flaum's uses a lot of food coloring in the Matjes, the only type i eat. Herring in the US is not so great anyway so if your store only carries Flaum, so do without imo. not always easy to find Schwartz's. u can get delivered.
