Monsey Man Gets Jail Plus 10 Year Probation For Child Sex Abuse

A Monsey man who pleaded guilty to a felony count of sexual abuse will serve up to six months in the county jail and will be registered as a sex offender with the state. Arthur Grossman, 40, pleaded guilty Wednesday to first-degree sexual abuse. Grossman was arrested June 8, 2010, by Ramapo police, based on a complaint from Rockland Child Protective Services accusing him of improperly touching a child's penis numerous times over a period of several years. The child was younger than 8.

A Monsey man who pleaded guilty to a felony count of sexual abuse will serve up to six months in the county jail and will be registered as a sex offender with the state.

Arthur Grossman, 40, pleaded guilty Wednesday in Rockland County Court in New City to first-degree sexual abuse, officials at the Rockland County District Attorney's Office said.

Grossman was arrested June 8, 2010, by Ramapo police, based on a complaint from Rockland Child Protective Services accusing him of improperly touching a child's penis numerous times over a period of several years. The child was younger than 8.

Grossman initially was charged with second-degree course of sexual conduct, a felony, and endangering the welfare of a child, a misdemeanor, in addition to the sexual abuse charge.

County Court Judge William A. Kelly ordered Grossman to serve 10 years' probation following his release from jail, officials said.

Grossman also was ordered to register with the state as a sex offender. The level at which he is to register will likely be determined during a Nov. 17 court hearing, officials said.

There are three levels of sex offenders in New York. A Level 1 offender is considered at low risk to repeat his crime; a Level 2 offender is considered at medium risk; and a Level 3 in considered at high risk. Only those assigned a Level 2 or Level 3 appear on the state's Sex Offender Registry website.

Reached by telephone Thursday, Kenneth Gribetz, Grossman's attorney, took no issue with Kelly's ruling.

"It's a tragic case," Gribetz said. "We feel the District Attorney's Office and Judge Kelly acted in a fair and just fashion."

dear devora the way to get the feds involved is by having preserve ramapo or other groups sign a peition to eric holder and to the fbi outlining what is going on and perhaps shmaya can write it and post it on his site and other sites

Speaking as someone who has defended alleged child molesters the reasons for these pleas are several fold:

1. The case is weak and the State does not wish to go to trial because of a reasonable probability of losing.

2. The State does not wish to go to trial to put the child through any further distress.

3. Sexual offender probation is onerous and has very many conditions. It is extremely unpleasant. A majority of such people on such probation violate and then are subject to a probation violation hearing. If the court finds that probation is violated then the defendant faces prison on the underlying charge. Sometimes prosecutors refer to probation as "the lay away plan." They refer to it as such because they will simply get the defendant at a later stage.

Many of the sexual offense cases are bad. The offenders are deviants and may need to be punished or segregated from society. But please also understand that many of the allegations are highly suspect. In my experience jurors tend to believe children no matter what (think of the Salem witchcraft trials).

Children are easily manipulated by psychologists and prosecutors. Husbands and wives begin to hate each other, seek divorces, and use the children in such perfidious manner.

Some children are so indoctrinated by their over-protective mothers about being "touched" that I would strongly advise you never to touch a little boy or girl lest the child say to his mommy: "That man touched me." You would be arrested before you could sneeze and might even be charged with attempted sexual battery of a child under 12 facing 30 years in prison.

Having said that I am fully aware of the many truly sick individuals who molest children.

It is indeed common for acrimonious divorces to include accusations of child molesting (usually the wife is the accuser, since she has the children with her, and can manipulate them against the husband). Once such an accusation is made, it is up to the man to prove he didn't do it. The legal system is turned upside down; the accused has to provide the proof, not the accuser. My ex-wife did this to me; all charges were eventually dropped, but it cost me a fortune in legal fees, then I had to pay my ex-wife's attorney fees. What a system.
