Family of slain Rabbi Gavriel Holtzberg and Chabad Lubavitch Movement, who had entered into a bitter legal battle over Nariman House, have decided to mutually end it. The family and the Movement challenged each other’s trusteeship of the Chabad of India Trust that manages the Nariman House.
Allegations and counter-allegations lead to the high court receiver taking over the possession of the Nariman House shortly before 26/11 anniversary last year.
On May 12, Rabbi Moshe Holtzberg, brother of slain Rabbi Gavriel, submitted in the charity commissioner’s office that his family has no objections to the change report filed by the Chabad Movement.
“We decided to mutually end the cases,” said Moshe Holtzberg.
On the earlier allegations of embezzlement, Holtzberg said, “Money is not an issue anymore. Mistakes were made due to our attachment to the place.I also accept that there was an issue of security concern and therefore the idea of building a museum. But the place will be lively like before and the focus is on rebuilding and the unity. “
Rabbi Yosef Kantor, Chabad-Lubavitch’s regional director whose trusteeship was challenged said, “Rabbi Mendy Kotlarsky of the Lubavitch World Headquarters, as well as Rabbi Eliezer Ashkenazi of Bangkok, have worked closely with Rabbi Nachman and Moshe Holtzberg,internalising their pain and continuing to communicate the organisation’s desire to perpetuate the work and legacy of Rabbi Gabi and Rivky Holtzberg.”
Here's what this means.
Even though the Holtzberg's allegations against Chabad – including embezzlement – were made public, there has as of yet been no independent audit of the funds Chabad raised to rebuild Chabad of Mimbai and to support Moshe Holtzberg, the toddler son of slain Rabbi Gavriel and Rivka Holtzberg – and now there will not be one.
Where did the money really go? We'll probably never know.

the money collected was meant for 2 things:
rebuilding the chabad house and for Moishele.
which means even if $10,000,000 was collected, this is where the money goes.
whatever leftover money from the rebuilding of the chabad house belongs to Moishele, for his upbringing, and for him when he grows up to do what he likes with it.
this is what it was collected for!
and no one has come out with a definite sum which was collected.

There's an old saying, "sometimes when people bury the hatchet, they don't always forget where it's buried".
My guess is that they were promised a nice pay off or the like - but if the terms are not implemented, the hatchet will be uncovered once again.

In general, you can't collect funds under the guise of a charitable tax exemption when those funds inure to the profit of a particular person. The multi-jurisdictional aspect of this campaign likely raises issues beyond immediate contemplation. Clearly an audit by a reputable, international accounting firm is in order.

There are plenty of commenters on this blog who will tell you what it was like going against the frumma. Chabad in particular. Questioning the mistreatment of Ethiopian Jews, the misappropriation of funds (fraud), pointing out theological inconsistencies, reporting sexual abuse, ect... It happened to me when I refused to accept schneerson as the messiah, adapt lubavitcher minhagim, and do the shliach's job for him.
I have no doubt Chabad would be ready to put this poor family in cherem now that they've sucked out all the donations possible.
