Rabbi Mordechai Tendler Subpoenas Google To Reveal The Names Of The Bloggers Who Exposed Him

Rabbi who was expelled from the Rabbinical Council of America for conduct unbecoming to a rabbi tries to do an end around previous court rulings to comple Google to reveal the names of the bloggers who reported on his activities.

A Subpoena Duces Tecum is a scrap of paper anyone can write and hand to anyone else. It is issued by the plaintiff's lawyer. It is not issued by a judge.

The recipient can challenge the party issuing it. It does not automatically require you to obey. You can force the plaintiff to appear before a judge and both parties can argue it.

my understanding is that most hosts do not provide identities and IP addresses unless instructed by a court. but after that, assuming the posters were using aliases, they would still need the ISP to provide a name for the IP address. many ISP's will not provide that until they have contacted the person involved to allow them to try to quash the subpoena. and in order to get a subpoena from a court, the plaintiff must usually provide examples of the items written which they feel were libelous and defamatory. this one didnt provide any such examples.

Mordechai Tendler thinks this is 2011 and wiki-leaks is for real. Does he not understand that he is dealing with the Charedi community that is still in caveman mentality. Does he not accept that Charedi Neanderthals do not use the internet for anything productive, only for pornographic and destructive purposes. Regardless of whether he is innocent or guilty of all of the charges (and nothing was ever proven or substantiated in a court of law or in beth din), Tendler does not understand that he is soiled, his name muddied, and his reputation destroyed. This has nothing to do with the truth. No matter how many email addresses and screen names he will expose, Tendler is in the garbage pile of history. Even if he proved that every single last one of his accusers was a prostitute, whore, mental case, deliberate nut-job, etc., it is too late. The only way he could possibly save himself is for him to find a cure to cancer. Then, all of this smelly garbage would only be a footnote to history. Other than that, Tendler continues to be a headline in the National Enquirer.

ok, so here we go with Mordecai Tendler again.

For those of you who just tuned in, here's a recap:

Multiple women from his shul in Monsey accused him of seducing them, including married women.
He denied the accusations for years.
An audio tape exists of Tendler trying to seduce a married woman. He never denied that it is his voice on the tape.
Allegedly, Tendler's wife Michelle came home one day to find Tendler at home and a naked woman in her shower. Tendler denied knowing the woman and Michelle filed a report with the Ramapo Police regarding trespassing.
Tendler had a "white noise" machine mounted outside of his office at the shul and office in his home. He often met with women behind closed/locked doors and used the device to conceal and sounds that may come from inside the room.
Tendler had sole control of a charity fund established by his shul. He used those funds to pay-off the women to keep them silent. Countless tens-of-thousands of dollars are unaccounted for, and Tendler refused to give his shul an accounting of how the funds were used.
A few years ago he seduced Adina Marmelstein, a single woman. He allegedly promised her that he would leave his wife for her. They were together constantly. Adina traveled to Israel to be with him, etc, etc, etc.
Eventually, Adina realized that Tendler was using her. She allegedly taped their conversations.
Adina sought help from other people in the community. With her help, a semen sample was collected which was later matched to Tendler using a hair sample collected from Tendler's son, Aharon Yosef.
The RCA (Rabbinical Council of America) hired an independent private investigator to research the allegations. At the end of the investigation, the RCA expelled Tendler from their organization.

The Monsey Rabbinical community held an investigation and Din Torah. Tendler refused to appear to defend himself. The committee, which represented all streams of Orthodoxy (Chassidic, Yeshivish and Modern), co-signed a p'sak halacha (which I posses) stating that Tendler is guilty of the accusations, confirmed the DNA evidence, and ruled that Tendler is unfit to serve in any rabbinical position.
The psak was written by Rav Benzion Wosner. Anyone wanting more information should contact Rav Wosner, Rav Feivel Zimmerman, Rav Orbach of Forshay, Rav Avrohom Yaakov Schorr, Rav Cohen (from Blueberry), Rav Chaim Schabes, Rav Yisroel Ciner, Rav Schwartz (of Wesley Hills), Rav Yosef Yitzchok Rosenfeld or any other Monsey Rav. They have all seen the signed psak, and some are among the rabbonim who signed it themselves.
Tendler was fired from his position at Yeshiva University and his role at the Rockland County Board of Family Service.
Tendler was fired from his shul.
Adina allegedly revealed to Tendler that she was leaving him and that she had taped their conversations (possibly including sex acts). He offered her $40,000 for the tapes. This conversation, too, is taped.
Adina filed suit against Tendler, claiming that he violated professional conduct rules by seducing her while he was serving as her counselor/therapist.
The case was dismissed, because "seduction" is not ground for legal action in New York, and the professional relationship (therapist) was not considered credible.
Tendler never denied in court that the allegations themselves were false, but only that they are not grounds for civil suit.
Tendler tried to intimidate various parties throughout this process by filing multiple lawsuits in Bais Din (in the US and Israel) and secular court. In all cases (except one, see below), Tendler withdrew the case when the defendant(s) agreed to the suit and their intention to call witnesses, including the women accusers and DNA experts.
The only Din Torah that Tendler didn't withdraw was one filed with a Bais Din that is known to be unashamedly corrupt (known in rabbinic circles as the "Agudas HaGanavim").
For the last few years, Tendler has been mostly laying low. During the week he davens at his father's shul and on Shabbos he has a small minyan in his house with his few supporters (Yitzchak Friedman, Grossman, Schrantz, Scheiner, Esquenazi, Sofair and Liebling).
Members of his father's shul are concerned that Tendler will try to take control of the shul when his father is no longer able to serve in that role.

For those of you who just tuned in, Tendler has been slandered in Star Chamber like proceedings.

He won the case in court and the appeal.

Now he's going after the guilty parties and going to make them pay.

Zipper - what it all boils down is to proof. None has been provided, on either side. I am so sick of hearing "alleged" or that tapes exist. The tapes were never verified (the fact that a Rabbi says something, does not make it so). Regarding the DNA, if it existed, then there would be no case here. Furthermore Rabbi Tendler would never have bothered to fight this to begin with.

Finally, if Adina first tried to blackmail Rabbi Tendler, why did she then sue him?

The story does not make sense. This is not to say Rabbi Tendler is innocent, just that none of this means he is guilty.

Here are the facts:
1. Rabbi Tendler has demonstrated poor judgment in how he fought these charges. The fact that he did not immediately sue the RCA for slander is a big question mark.
2. The people accusing Rabbi Tendler have not been 100% truthful and most, if not all, had a previous grievance with Rabbi Tendler.

Correct me if I am wrong, but despite Mordechai being ousted from the RCA, his Father stayed in the RCA. You would think if there was no basis for the expulsion, R' Moshe Dovid would have quit in a heartbeat.

There is concrete forensic evidence.This evidence was actually produced in the Bais Din of Harav Zimmerman, Harav Ohrbach, Harav Diament. Based on this evidence the Bais Din ruled that he can no longer serve as a Rav. In the event that the Bloggers are outed, I can 100% assure you that this will be posted on all blogs!

Tendler was given the opportunity to provide his own DNA sample (cheek swab) to prove that the semen is not his. He declined every opportunity to do so.

He was fired from 3 separate jobs, in part based on the fact that DNA evidence was provided to his employers. If he were innocent, why wouldn't he provide a simple cheek swab to a certified DNA lab to prove his innocence? (Answer: he knew he'd fail the DNA test.)

Rest assured, if Tendler didn't get the Marmelstein case thrown out in court, the tapes and DNA evidence would have been presented.

Let's be clear, Tendler did not win the case based on his innocence or by refuting the allegations against him. In fact, he did not "win" the case at all. He argued successfully that the case should be dismissed.

Anyone who claims he "won" the case or was "proven innocent" is simply naive.

By the way, tapes do exist. One tape was played in meetings arranged by Rabbi Ciner. I was there and heard the tape. So were many other people.

If you support him, then why not ask him to provide a DNA sample (cheek swab) to any certified DNA lab he chooses? Really, ask him. Let us know why he refuses to do so. The semen sample is still available to prove/disprove that it is his.

By the way... Tendler would never sue anyone based on the circumstances of his dismissal. Not the RCA. Not YU. Not KNH. Nobody.

Every suit he filed, he later dropped rather than face the evidence against him when the other party agreed to meet him in court. Why in the world would an innocent person drop the case and the ability prove his innocence before an impartial court? (You know the answer.)

Tendler surely wouldn't sue the RCA for slander. Why? A) They never said anything about him. They just ejected him from their org without comment. B) They have access to the same evidence that the Bais Din has (witnessed, DNA, tapes, etc). The truth is never slander.

Let's solve this issue once and for all. I challenge Mordechai Tendler to submit a sample of his DNA. We will send his sample to any reputable lab of his choice. The Bais Din will then release the DNA sample which they possess ...if this is not a match we are prepared to get him back as Rabbi of KNH and will arrange to have him compensated to his satisfaction. All Bloggers will apologize in public and ask forgiveness from him and his family!

Tendler kicked ass in court and adina marmalstein makes charlie sheen look like koffi annan on zoloft. The entire monsey knows that shul is full of pissants and isn't worth an omein yehei shmei. If not for the even flakier yeshiva tenant that shul would be bankrupt. That place post tendler is the taint of klal yisroel.
