Maybe we should have a Rubashkins sticky where we can see all the day to day tidbits on Sholom's life. You know, where he is, what he is eating, if he has a cold, who is visiting him etc.
I have never used Twitter but this seems to be a perfect twitter topic to follow. Maybe Chabad has one?

I'd still like to know how much they have solicited in donations and where the money is going. A trial and appeal even with high price lawyers does not cost as much as they appear to be hauling in.

Posted by: effie | July 16, 2010 at 10:18 AM
Sounds terrible! I read Father Whatshisname's account of being transported around the American Gulag and its just shocking that our bureaucrats operate such a dehumanising institution such as this prison system, which seems be filled with people who would mostly be better elsewhere (e.g., mental institutions, rehabs, jobs paying off their debts).
It would probably save huge amounts of tax dollars to give most of these guys large fines, and let them pay in the system, rather than maintain them as semi-permanent public wards. The priest's mention of "meds" points to the probability that most of these folks are older, and may well have psychiatric problems -- in contrast to our normal concept of malicious, drooling criminal types hell bent on evildoing.
Janet Reno once publicly espoused a philosophy of focusing the criminal justice system on cornering the "baddies," and leaving the occasional or one time offenders to less coercive means of punishment or rehabilitation.
I say we probably need a old-fashioned, European-style General Amnesty or General Pardon to clear the system out and start over. It always amazed me that, historically, a new leader on enthronement would be acclaimed by the populace for pardoning the jailed. This was seen as a great act of mercy. But we democracies are harsher than absolutist rulers. For some reason unbeknownst to me, pardons and forgivenesses are anathemas in the American democratic milieu, whether for a great prisoner of state, or a visa overstayer. We are merciless to those who transgress against our laws, however technical they may be.
But, of course, we have the view of our courts and prisons as ultra-fair institutions, where justice prevails and everybody is treated fairly and equally, by socially concerned police, prosecutors, jailers and officials. At least when we aren't screaming for people to be punished in ways that would shock a human rights activist.
Punishment needs to be efficient, as well as cheap and easy to administer. I think a return to corporal punishment would be far cheaper, more human, and much more effective than the operation of a multi-billion dollar Gulag/Prison Industrial Complex. Short, harsh sentences at hard labour should accompany most major crimes, and the opportunity to reform should always be held open except for those established to be recidivist. But warehousing 2 million plus people in this national Gulag with these ridiculous sentences (e.g., 27 years for cooked books) is a crime against the humanity of the offenders, as well as against the taxpayer who must pay for this largesse.
I say the cat o' nine tails delivered far more efficient dividends.

this is getting a bit old. he has been convicted, he is in jail, whether he likes it or not he will pay by being there for quite awhile. a chilul hashem is still going on in the larger community that continues to support the criminal... this is worth discussing, but why bother discussing SMR himself anymore? his case is closed. all the comments here are just mean spirited and they add nothing to the larger and more important debate over ethics (or lack thereof)and the orthodox community.
Posted by: chaim | July 16, 2010 at 10:23 AM
His case in't closed until he has had his appeal.
And Anderson: If you don't want to be treated like a criminal, don't commit crimes. General amnesty? Corporeal punishment? What planet do you live on?

Torah Law proscibes, that one caught stealing, MUST pay back 100% of what he stole plus 20%, with NO incarceration.
How about $120 Million from the RCF secret Bank Accounts, to make ALL of the Secured and un-Secured Creditors whole, after which, SMR be released from his prison sentence.

I don’t know if is a victim of anti-Semitic or of one of the worst judges in the country, however the arguments you are using are nonsense, since SMR was never convicted for obstructing justice, perjury, bribing a public official, hiding assets (he does not have). I have all the right to believe that the judge used perjury, sentencing guidelines just as a excuse and had no proof what so ever that SMR lied to her, And did everything in her ability to calculate the money and severe ness f the crime so she can give him the longest possible sentence.
Sentencing guidelines are calculated differently by different judges. Stop defending the judge with nonsesnse

This weeks Prasha is Devarim or for the Hebrews who are loshon hakoydeh challenged aka Deuteronomy 1:1-3:22. Let us bench Goht that Sholom Rubashkin enjoys many Shabosim behind bars courtesy of the US Government and our tax dollars for his criminal acitivities that cheated, robbed and stole from the greatest country in the velt and of it's citizens both Jews and Goyim alike.
Not only should he rot in prison for many Shabosim to come thanks to The Abishter but also Yom Kippurims, Purims, Paysahs, Seekehes, Christmas, 4th of Julys, Labor Days, Chanukahs, Cinqo De Mayo and St. Patrick's Days.

Hi Nachos,
I don't know how much the RCF has stashed away in offshore accounts.
Maybe the Feds know, through their investigations, in cooperation with Swiss and other offshore Banking Authorities.
The point I was trying to make is, if these funds are available and the RCF wants SMR out of prison, making full restitution to ALL who they stole from, may do the trick.
Certainly, this is better, than having the American taxpayers paying a fortune, to have SMR incarcerated for 27 years.

I am interested, but I am also interested if he is able to eat dairy during the nine days, if he able to daven with a minyan on shabbos with the throngs of haredi criminals in prison but I don’t need blaring headlines announcing
"Prison Allows Sholom Rubashkin to Have Dairy During the Nine Days"
I think a sticky that gets updated with timely information is much cleaner. I understand the need to make this blog "look" busy with Jewish “crime”, but "stories" that simply update an ongoing situation with non critical information would do nicely with an update to a single post. Call it “Sholom’s Diary”.

Hi Effie and Nachos,
Good comments.
But in an ideal Torah-Driven world, what I mentioned would be better.
There would not be stealing in amounts that could not be repaid and so forth.
Yes, AR doesn't give a sh-t about his son or his family.
He's a typical Cime Boss, who lives in a world where he is in absolute control, with everyone else, including other family members, completely expendable.

Good concept Sage, Effie, Nachos re paying big fines for big $crimes, but unfortunately, many of those criminals would be perjuring themselves by admitting they had a stash. And yes, the poor would get the shaft, much as they do now because they can't afford good lawyers/good bribes.(shades of Michael Jackson/OJ Simpson). I also find the comments or lack of comments about Aaron quite thought-provoking. What role does he play in this? After all, wasn't he the owner? Or is it being played out in comparison
to a renter being busted for running a meth lab in a house unbeknownst to the landlord? Any interviews with him available either currently or from the past Shamarya?

I have a great idea. Let the idiots of chabad offer to raise the full sum he defrauded and make restitution in return for the sentence to be dropped to one year.
I would not contribute one cent to the campaign, but these chabadniks are master fundraisers. If the banks can be made whole, the sentence can be commuted.
At the same time, this would tell the chareidi community to put up or shut up.
I am tired and bored with this. I am much more interested in Jonathan Pollard, who rots, with no one rallying on his behalf.

Isa & Snagg: I have to agree, Lynne Stewart acted horribly. When I first heard what she did, I couldn't believe she would do something so evil. She knows why messages are not to be communicated and why. It won't be long before she is applying for a pardon or an early release due to medical reasons. They better not give it to her. She committed a serious crime with her eyes wide open and until her butt was thrown in prison, she was quite proud of her actions.

It's not a good idea to piss off a judge...
Isn't this the same judge that originally gave her a slap on the hand and had the sentence reversed by a higher court?
Posted by: effie | July 16, 2010 at 04:26 PM
The problem with sentencing people to life in prison instead of the death penalty, is that they can continue to commit acts of terrorism and order people to be killed.
Posted by: effie | July 16, 2010 at 04:27 PM
Effie, yes.
"...Judge John Koeltl said that even though he could have originally sentenced Stewart to 30 years, he thought the 28-month sentence he initially handed down was tough enough, given her age, poor health and decades of helping the less fortunate...He said her gloating after the original sentence changed his mind. "The comments made after the sentencing indicate the defendant did, indeed, view it as a trivial sentence," Koeltl said..."Similarly, the lack of remorse for conduct that was illegal...also indicate the sentence was not adequate," Koeltl said.
An appeals court had ordered the new sentencing, saying Koeltl needed to consider a longer term, given the government's arguments about Stewart having lied on the witness stand..."
Rubashkinites, take note.
Posted by: WoolSilkCotton | July 16, 2010 at 04:32 PM
WSC: Stewart was thumbing her nose at everyone up until the time she was remanded into prison. Regardless of her age, poor health, and helping the less fortunate, she knew what she did would result in people's deaths. She just didn't care. Also, she chose to represent the poor and she was compensated for doing so. I just have this fear that she will be getting out soon. This judge made a terrible mistake and I have to wonder what the hell he was thinking he was doing.

What a slimball turning the Rubhskin sentence into a discussion about the Church, God and Yosseleh's values.
Last time I checked the Church did not committ 87 plus crimes.
Instead of playing the hate card it examine the charges and sentence Rubashin recieved.

And with the way you look I understand
that judge was not impressed.
But I heard you let that little court officer take off your Polish dress.
I'm not going to get too sentimental

I only know you're not eating swine.

Well I see you've got a "husband" now.
Did he leave your pretty payot lying
in the soap cake?
You used to hold him right in your hand.
Bet he took all he could take.
Sometimes I wish that I could stop them from talking
when I hear the silly things your supporters say.
I think somebody better put out the big light,
'cause I can't stand to see you this way.

Oy, Rubashkin, my aim is true.
