First report: Sabar Kashour, convicted of rape after posing as a single Jewish male, petitioned the High Court of Justice Thursday in a bid to reduce his 18-month prison sentence, Ynet learned.
According to the appeal, the conviction prompted global outcry and led to accusations that Israel's legal establishment is racist.
"It appears that we, in Israel, would also feel a sense of unease had we heard that a Jew was convicted of raping a Christian woman abroad - even though they engaged in consensual sex - just because he did not reveal his Jewish roots," the petition read.
Attorney Elkana Laist is claiming that the District Court's sentence went much beyond the norm, given that his client engaged in consensual sexual relations with the complainant.
"It's hard to believe that a person who engaged in sex a few minutes after the initial meeting gave much weight to the statement that her partner was interested in a serious relationship," the attorney said.
The judges who sentenced Kashour ruled that he showed basic human indifference towards his victim, yet the appeal charges that this statement constituted "an outdated, patriarchal worldview whereby only a man can enjoy sex, while the woman cannot enjoy it at all and would only consent in exchange for a promise of a relationship, and only as long as this relationship involves a man of identical ethnicity"
The appeal also argues that the court did not give enough weight to the fact that the meeting between Kashour and the woman was random, rather than a case of pre-planned fraud.
"We are dealing with a man who has no criminal record and a one-time offence that did not involve the use of force and that was mostly about presenting a false image," the appeal says.
Given the arguments presented in the appeal, Kashour is asking the court to significantly reduce the sentence and annul the 18-month jail term, leaving only a conditional sentence in place.
Is it true that arabs do not enjoy sex unless they keep their eyes open and have others in the room?

I would hope so, CM. What this fascist pig of a judge did was outrageous. This guy is no rapist. He simply said his name was "Dudu" instead of Mohammad. And even if he said his name was Jesus Christ, he still wouldn't be a rapist.
This may be the first time ever that I spoke up for a Palestinian.

One of the three kangaroo court "judges" who sentenced Kashour to 3 1/2 years in the slammer (counting the two years home detention Kashour has already served) is the illustrious Moshe Dror.
You may remember Dror. He was the stinking pile of judicial excrement who let the son of the Chief Rabbi of Sefad skate after he (the yeshiva bochur son) deliberately ran over an Ethiopian Jewish parking lot cashier in an attempt to evade payment. In the USA -- even in Selma, Alabama these days -- that would buy you a lot more than 3 1/2 years with the Bubbas, Billy Bobs, and Chainsaws who inhabit our state penal institutions. Dror's rationale was that this yeshiva bochur was studying to be a judge himself, and he didn't want to ruin the yingele's career.
Thus the moral of the story is: If you deliberately commit felonious assault upon an Ethiopian Jewish woman, you get a pass. But if you're a shaygetz, especially one of the Islamic variety, and you have consensual sex with a Jewish tart, your ass is going straight to jail.
Dror: You're an asshole, and unfit to be a judge. Segal: Ditto.
I understand that it's a crime in Israel to insult a judge. Well, get the Mossad on my tail. Bring it.

After the interview he gave in the last article you published about him, I am quite convinced that it really was rape.
- he went up to the roof with the girl
- he understood "from her behaviour" that she wanted sex
- she told him she did not want because people were watching
- he had sex with her regardless
- he left her lying naked on the roof, till other people found her and brought her to hospital, where she was examined. It was clear that intercourse took place, but the doctors did not reveal traces of violence
- two days later, she filed a complaint for rape, but did not have his name or whereabouts.
- some time later, he calls her, because he wants more quick sex with her.
- she says she agrees to a meeting but does not show up
- she does not answer later calls
- she now has his phone number, can identify him and sue him, which she does (for rape)
- during the trial, they threaten a smear campaign against her (must be along the lines: "she always was a slut, so of course she agreed to sex")
- so, in a plea bargain accepted by the defendent, she settles for rape by deception instead of actual rape.
- he has a bad surprise when he is still convicted for 18 months on this lesser charge, so he goes for appeal (after having agreed to the plea-bargain).
The guy is married and has children, but takes "casual sex" for granted.
He leaves a woman naked after sex and still thinks she will want more sex with him...?
What a complete asshole.
I think he deserves his 18 months. Of course, it is a pity that the judges mentionned his being arab. To me, it is completely irrelevant.

1. The woman called Kashour a month later, not two days. Left her number on his cell phone. How else did Kashour get it?
2. He calls her, asks for a date. She agrees but doesn't show up. That part you have right.
3. She now has the name of this "rapist," and knows he's really not Jewish.
This woman is one of those sluts who files false rape charges. The case would have been thrown out entirely, based upon the physical evidence of no forcible sex, had it not been for the discovery that Kashour wasn't Jewish.

No: the article (quoting Kashur himself) says that he took her cell phone number (on the roof) and went away: he had hers, but she did not have his.
One month later, he calls her, she takes the opportunity to identify him.
I would say: if you were raped and you rapist calls, it is quite a good idea to
- take his cell phone number
- try to get him somewhere where he could be identified.
The fact that Kashour himself says that she did not meet him after the incident on the roof, nor take his calls once she had identified him, would point to the fact that she did not want to have sex with him. Apparently, she did not even want to go near him...

I do not think that every rape leaves "traces of forcible sex". It's as absurd as saying "she did not shriek, so it was no rape".

How did get this information?
I just want to say: What Kashour says about his attitude to sex marks him as a total asshole, and I would easily believe that once a woman is with him on the roof ("what did she think I would do, pay her a drink?") he thinks he can have sex with her. Which would be the epitomy of date rape if she does not agree.

All testimony indicates the woman LIED about being raped, and reported a rape simply because it was a case of "Ram, Bam, thank you ma'am." She wanted dinner and a movie (in this case, afterwards), and instead got a quickie.
But my point was really the utter hypocrisy of these three judges, one of whom, the estimable Justice Dror, who gave a yeshiva bochur a pass in an obvious felonious assault case involving an Ethiopian Jew.
Make no mistake about it, the only reason this shmuck was sentenced was because he's an Arab.

While I don't think the guy should have been sentenced for rape, he is a Grade A jerk. He represented himself as Jewish in order to get sex that the woman would not have consented to otherwise.
Women have a big problem with men who misrepresent themselves to get sex that the women would not agree to otherwise. Men say they are single when they are married. They won't marry women of another race or religion but seek to have sex with said women by pretending to be sincere suitors, etc.
I think there needs to be the possibility of civil action against such men. The behavior is low, dishonest, and manipulative. Men should NOT be able to LIE to women to get sex and escape scot-free.
