Does a Kosher Butcher’s Fraud Mandate a Life Sentence?

At middle age I have come to accept my limitations. Although I like to have an opinion on almost everything, I am conscious of the fact that I am not a legal scholar and do not understand all the complexities of the criminal case against Shalom Rubashkin, the former CEO of America’s largest kosher meat plant, Agriprocessors of Postville, Iowa.

But I am not a stupid man either. And I, and a heck of a lot of other fairly intelligent and educated people are scratching our heads as to why government prosecutors are requesting that Rubashkin, who has ten children, including an autistic son, and a reputation for enormous philanthropy, be given a life sentence in prison.

A life behind bars. The very words are ominous. Isn’t that reserved for society’s most heinous offenders? Life sentence has one conjuring images of rapists and murderers, international drug cartel kingpins and white-collar criminals guilty of gargantuan fraud, like Bernie Madoff.

Because:

1. He was convicted on 86 fraud counts.

2. He committed crimes while out on bail, including obstruction of justice and bribing a public official.

3. There ar other crimes he also committed and could be tried for.

4. The sentencing guidelines allow for including those other crimes and the bribery and obstruction of justice in the sentencing calculation.

Past that, Rubashkin's attorneys asked for a departure from those sentencing guidelines. The guidelines call for 21 to 27 years for the 86 convictions. Rubashkin asked for no more than 6 years.

The government responded by upping the guidelines (as I noted above), adding in the bribery, etc.

The judge will view both requests, listen to evidence during the two day hearing on April 28 and 29, an will then hand down a sentence.

Rubashkin turned down a plea bargain just before his trial. The offer was 12 years if Rubashkin would allocute to his crimes. He refused.

I doubt the judge will give him less than 12 years plus some, meaning about 15 years.

When you realize Rubashkin has never shown remorse, accepted guilt, apologized, made restitution or cooperated with the government, 15 years isn't so bad. He could easily get 30.

And that sentence has nothing to do with his religion, or yours.
