Rubashkin faces new charges
BY GRANT SCHULTE • Des Moines RegisterProsecutors have added wire and mail fraud charges to the slew of allegations against former Agriprocessors executive Sholom Rubashkin, according to a seventh federal indictment filed today.
The new, 163-count indictment adds nine mail-fraud charges to the allegations against Rubashkin, and 14 counts of wire fraud.
Prosecutors allege that the former Postville meat-packing executive requested by fax advances on a $35 million bank loan. The requests were based on false information that was sent to the plant’s largest lender, First Bank Capitol of St. Louis, according to the indictment.
Government lawyers also allege that Agriprocessors mailed false financial reports to the bank, in violation of federal law. Each new charge carries a maximum 30-year prison sentence and a $1 million fine if Rubashkin is convicted.
“This is unprecedented,” said Rubashkin’s attorney, Guy Cook. “From Mr. Rubashkin’s perspective, it confirms the overreaching by the government.”
Cook said he will likely ask U.S. District Judge Linda Reade to postpone the trial in light of the new charges. Rubashkin will plead not guilty to the charges, “whether it’s one count or 163 counts,” Cook said.
Rubashkin sits at the center of a massive federal case against the Postville plant and several managers. The kosher slaughterhouse was the site of a major immigration raid in May 2008, when federal agents arrested 389 illegal immigrant workers from Mexico, Guatemala and other impoverished nations.
Charges listed in the indictment include immigration offenses, document fraud, bank fraud, making false statements to a bank, money laundering and ignoring an order of the U.S. Secretary of Agriculture.
Prosecutors also dropped two counts of harboring illegal immigrants in the new indictment.
Bob Teig, a spokesman for the U.S. Attorney’s office, declined to say why prosecutors added the new charges.

Great news!!!
The Feds are showing that they have the cajones to keep the pressure on and apply it at the right time.
As usual SMR continues to plead not guilty.
He will pay a massive price for his arrogance, when the Court Costs are added to any fines the Court may levy.

“This is unprecedented,” said Rubashkin’s attorney, Guy Cook. “From Mr. Rubashkin’s perspective, it confirms the overreaching by the government.”
Overreaction, Mr. Cook?!! Try reality... Frisbeetarianism!

Sage,
I agree with you, this is GREAT GREAT NEWS!!! I was beginning to feel down and thinking there isn't any justice in this world. May he pay the price for all of his sins against mankind, animals and the world!! This will make Postville residents rejoice!

Yes,
And my wife and I are really looking forward to being in Postville, after the RCF is put away for good, to join with the citizens in thanking G-d for seeing that true justice was finally done.
May G-d cause this speedily to happen.

What else can they pull out of the woodwork!I'd be curious to know how he's been spending his time since the raid. Surely someone so innovative can't keep his hands out of the cookie jar for long!

Sage
We may have to wait to "see true justice was finally done." But it is interesting that they are moving away from immigration issues and concentrating more on fraud charges.

Yes.
And Iowa and the Feds are in the process of preparing indictments for State and Federal Labor Law violations.
And looming over all of these, is the very real potential for Federal RICO indictments.

Unbelievable (not really)
Please excuse me. I must 'peel' myself off the floor after a hearty 'peal' of laughter.
. . . and to quote Sage on an ancient post . . . 'I don't know whether to laugh or cry.'

Guy Cook is going to push to have the trial postponed until either he stops getting paid, or the defendant drops dead.

Oh, I forgot to mention the Iowa Child Labor Law trial with 9311 counts.
It's frankly astonishing to witness the utter ingrained arrogance of SMR.
Many more rational folks facing what he is, would put themselves out of their own misery, by pleading guilty and throwing themselves on the mercy of the Courts.
Utterly amazing, an intelligent and well educated person carrying on like this.
But this fellow is in a very different class from the rest of us.
A really sad human tragedy, if I may say so.

I do not wish adverse fate toward anyone; however, I wonder what the scenerio would be like if 'dear ole Dad' was absent from the picture ? ? ? ? ?

I also do not wish harm toward anyone. I just get annoyed with some of the comments made by corporate spokesmen, PR agents and lawyers to reporters.

Sholom Rubbishcan is the Bernie Madoff of Kashrut.

Heshy is around waiting in the wings to take over as soon as shitpile gets "sold" ( of course we know the RCF with the blessing of its pimp the OU will be the de facto owners. How do we know this? Why else would all the chabadnik camp followers still be hanging around, if not for the return of the RCF, BigChabad? Of course they "know" Agri will have a sort of slaughterhouse makeover, reopen, and everything will be as it was. Or did you really think they are waiting for the largess of Friedman et al to trickle down on them? RCF is the makeup, RCF is still pulling the strings. If you don't believe this, wake the fuck up.

YL,
You need to copyright your statement.
How true, how true!!!!

Sorry, the next to last sentence should be SHF is the makeup.

Cook had better come up with some new "antisemitic" stuff quick.

Hi Y&1/2,
Very compelling comment, as usual.
Please go to the top of this blog and input your thoughts.
It's claimed that the US Attorney has vetted the sale, said to take place this comming Wednesday.
My gut feel tells me that something smells.

Was by SMR' residence yesterday and the house was closed up. No garage open, no toys in the yard--as if the family were on vacation. Did he need to be in Court for the new charges? This was around 10:30 a.m. that everything looked shut up.

If he needed to be in Court, legal folks would have escorted him there and there would be news reports.
Maybe he's gone into hiding, afraid of his personal safety.
Or maybe he cut off his UPS device and fled.
Who knows.
Please keep us updated.

"May G-d cause this speedily to happen. "
Gee - just think - most jews around this time are using this phrase in relationship to the 3 weeks and the rebuilding of the temple (you are aware it's the 3 weeks)
"He will pay a massive price for his arrogance, when the Court Costs are added to any fines the Court may levy."
sage - (that is your name isn't it - I suppose we choose names based upon what we aspire to be) what in the world do court costs have to do with anything?
But this fellow is in a very different class from the rest of us.
"But this fellow is in a very different class from the rest of us."
I gotta admit - you're certainly in a class by yourself
"Please go to the top of this blog and input your thoughts."
Please sit in front of the class by the teacher!!
"Maybe he's gone into hiding, afraid of his personal safety.
Or maybe he cut off his UPS device and fled."
Or maybe none of the above
"Who knows."
probably not you
now that drink . . .

A few years ago I was told not to buy Empire because they have problematic kashrut, not to buy number of other brands. When I asked what is reliable the rabbi said - buy Rubashkin. That is what we have done for number years now.
Now we found out that Rubashkin is a criminal. Who should be trusted then?
Posted by: Ben | July 17, 2009 at 01:33 PM
Keep the charges coming! I hope that the truth comes out and that Rubashkin and his Chabad cohorts are prosecuted to the full extent of the US law. And, do we really have to eat so much meat? I mean, it clogs the arteries, causes heart disease, and the people who sell it are apparently very corrupt.
Which is better? Buying such horrible kosher meat with so many question marks concerning its validity or eating some healthy vegetarian or dairy meals?

I just read the 50+ page indictment on this web page. It's very clear, very well written and it clearly lays out a host of crimes that Rubashkin and his generals committed.
I think that God has a message for Rubashkin and his generals: "You are going down Rubashkin."

[Rubashkin and his generals]
Referring to those closely affiliated to Rubashkin as 'generals' gives me the creeps almost as much as the creepy feeling SMR followers project, those who reside in the Postville community.
