Justice also means bringing cases on a timely basis. There is no justice if someone makes an allegation 40 years after the alleged incidents, when all witnesses have moved away or died.
What really needs to be done is set up institutions so both Haredi Jews and Roman Catholics can rat out the abusers without fear of consequence, and to punish those who would obstruct justice by threatening victims, whether explicit or implied.

Why do I get the feeling that this is more about the money than about justice? Considering the amount of time that has transpired wouldn't opening up a window to criminal prosecution but not litigation accomplish what is supposedly wanted? I fear that more time and energy will be spent on not prosecuting the perpetrators but about suing whoever is connected to them that have assets that can be sued. The economy is tough and this will be a mad dash for the cash.

I AGREE with Mister Apikoros. We cant afford to educate and care for our children if the entire public sector becomes financially liable for alleged crimes that happened 40 years ago. Have you seen the cutbacks our schools are already facing? I am sorry, but neither myself, my staff, nor the 1400 students we service. Please, take that into consideration. Statue of limitations exist for a reason. Think of the children

Statutes of Limitations do NOT exist to protect criminals. They exist to set reasonable limits on prosecution or suit based on the crime.
In most states, murder has NO SOL. So you can easily see SOLs are not set based on fading memory, etc., or on criminals' "rights."
If your school knowingly and/or negligently employed or harbored a child molester, your school should be sued.

Scotty, your conflation of theories and skipping over the details won't make your argument right. No one has a problem with eliminating the SOL for criminal prosecution of child molester or for that matter even civil claims against child molesters. The issue is with civil claims brought against schools which typically are brought based on some negligent type theory. Sometimes the negligence allegation may be warranted often they are less clear.
And yes, SOL are based in part on concerns about fading memories. They are also designed to protect the rights of the "defendant" who may or may not be guilty or liable.

Nope.
SOLs are based foremost on the crime.
Now that clear medical evidence exists showing victims of child sexual abuse rarely are able to come forward before their 30s, the SOL should be changed to reflect that.
The Markey Bill does so for civil matters.
Eventually another bill will do it for criminal.
As for the institutions, if they harbored known molesters – the Torah Temimah and Kolko – then they should be liable, even years later.

The victim of murder can not act as a witness, a victim of pedophilia can. More so, pedophiles have lots of victims making proof easy.
There should be no age restrictions on justice. The most violent pedophiles victims will not wake from their trauma until many time 40, 50 + years.
If we can not prosecute, this becomes the perfect crime. People should understand trauma first.

Question
One of my abusers, violent sexual abuse ages 8 to 10, is now a bishop. Most bishops have been accused of cover-ups and abuse of children. Is it possible that to become a Bishop, you have to be dirty?
And our politicians actually listen to them?
