Orthodox "Forum" Quietly Handles Cases Of Sexual Harassment, Ma'ariv Claims

A reader sent me the following rough translation of an article that appeared in Ma'ariv yesterday. In effect what the article claims is that some Orthodox groups in Israel have formed a "forum" to handle sexual harassment and abuse cases where the victim(s) is afraid to go to the police. This forum goes to the abuser and tells him that either he cooperates with them or they go to the police with the information. Conversely, they tell the victim that she must testify before them or they will make her name public.

I think this can work in a society that grants religious courts bailiff powers – but only with real oversight. The forum claims it is the perfect vehicle to deal with high ranking rabbinic offenders. Why? Their solution is to ban the offender from teaching or holding other posts within the community that would allow him easy access to more victims. Of course, this offender can at any time leave Israel and resume his life as normal anywhere else he chooses. How this forum could ever deal with that is unclear.

It appears to me this forum may have been set up to prevent victims from going to the police and that the supposed punishments handed out will only ensure that abusers will abuse – but outside communities that use the forum. It also does nothing to prevent abusers from abusing neighbors, people they meet on the bus or in the store, etc. A flawed solution, at best.

Breaking the silent connection
In the Religious community they have found a new way of dealing with sexual molesters without handing them to the police. The goal: Punishment without the painful exposer

Sexual harassment occurs in the religious community, too. Contrary to the relatively high awareness existing in wider society,  in the religious community they are confused and tend to hide its existence. Whoever was abused swallows their pride and hides the pain just not to be exposed. When the molester is an educational persona or an influential rabbi of the community, the chances for the molestation will be made public and the molester to be punished are especially slim.

For that reason, a special forum was started in order to prevent sexual molestation within the Orthodox community. Its goal is to allow the victim to charge the molester without reveaing their identity. The forum dealt with some cases some very difficult cases, anonymously and with great success. A list of complaints that were proven true resulted in some severe actions toward the molesters.  The members of the forum say that if not for their intervention the victims would have never gone through to the police and the molesters very likely might have gone on...

Recently a number of central figures in Jewish education were forced to leave their positions and their chances to advance professionally was put to stop. This was done after suspicions were checked. They were not publicly identified, the police were not involved. After the forum got involved they voluntarily resigned.

The forum gets its strength and is able to take some strong steps against molesters due to the organizations that back it up. Educational organizations, women's groups, yeshivas etc....
They named it: "The forum  for the prevention and dealing with sexual harassment," and its method of operation is simple: If the molestor does not cooperate, the police will be notified of the case. If the victim does not come forward and refuses to testify, the story will be told in the community...

These directives seems to be quiet clear and effective and seems to work!  Thanks to the ethical leadership that the community adheres to. The forum consists of rabbis m'chancot and lawyers. They allow the victim to stay anonymous and call the offender in. After the case is investigated and when found guilty they remove the offender from any position of harm doing. They don't work in place of the police. They intervene in cases that otherwise would have not been handled the victim is too embarrassed or intimidated to go public. The offender feels the heat from his own community. The forum's goal is:
"ובערת הרע מקרבך"translation: Get rid of the evil among you."

    הטרדות מיניות מתרחשות גם בקרב בני הציבור הדתי. ואולם, בעוד שבציבור הכללי קיימת היום מודעות גבוהה יחסית לתופעה, הציבור הדתי עדיין נבוך ונוהג להשתיק את דבר קיומה. מי שהוטרד סופג את העלבון, כובש את הכאב ובלבד שלא ייאלץ להיחשף. כאשר המטריד הוא דמות חינוכית, או אפילו רב בעל השפעה בקהילה, הסיכוי שדבר ההטרדה ייחשף ושהמטריד יבוא על עונשו, קטן במיוחד.

בשל סיבות אלה הוקם פורום ייחודי למניעת הטרדות מיניות בקרב בני ובנות הציבור הדתי. המטרה היא לאפשר למוטרדים להתלונן בדרך שזהותם לא תיחשף בציבור. ואמנם, הפורום טיפל בשורה של מקרים, חלקם קשים, בחשאיות ובהצלחה מרובה. שורה של תלונות, שאמיתותם הוכחה, הובילה לנקיטה בצעדים חמורים כלפי המטרידים. על פי עדות חברי הפורום, ללא פעולתם התלונות לא היו מוגשות למשטרה וקיימת סבירות גבוהה שהמטרידים היו ממשיכים במעשיהם.

אנחנו מאוד אוהבים את המחשבה על זה שרב בישראל, ישכון בבית הנשיא. אבל משום מה, רק עיתונאים חילונים עושים את המלאכה וכותבים על עברו של המתמודד הדתי לנשיאות. ואנחנו? אנחנו שותקים

רק לאחרונה הצליח פורום זה לאלץ מספר דמויות מפתח בחינוך הדתי לעזוב את תפקידיהם ולעצור את התקדמותם, זאת לאחר שנחשדו בהטרדה מינית. נגד אישים אלה לא הוגשה תלונה במשטרה ושמם לא נחשף בקהילתו, ובכל זאת, בעקבות דרישת הפורום הם בחרו מרצונם החופשי לסיים את תפקידם.
הפורום שואב את סמכותו לנקוט בצעדים חריפים כלפי בכירים במגזר מכוח הגופים החברים בו. הוא מאגד את המערכות החינוכיות המרכזיות בציונות הדתית, קרי אגודות השירות הלאומי, ארגוני הנשים, רשתות החינוך, ישיבות תיכוניות, ישיבות הסדר ואולפנות לבנות.

השיטה של הפורום, שנקרא "הפורום למניעה וטיפול בהטרדות מיניות בציבור הדתי", פשוטה, וכוללת סנקציות. בין היתר, מודיעים למטריד כי אם יסרב להצעה, תוגש נגדו תלונה במשטרה, או לחילופין, אם תסרב המתלוננת להתלונן, יפורסם דבר ההטרדה. בציבור הדתי, שבו פועל הפורום, מדובר באיום שלא מצריך הבהרות נוספות. עד כה קיבלו עליהם כל המטרידים את דינו של הפורום, גם אם היה קשה וכואב. הציות נובע מהכרה בתוקפם המוסרי של האישים החברים בו ומתוך הבנה של המשמעויות  החמורות של אי ציות לגוף המאגד את ראשי הקהל ואת כלל הארגונים החשובים בציבור הדתי.

בפורום זה חברים רבנים, אנשי ונשות חינוך, ומשפטנים ומשפטניות. בין היתר, הרב אהרון ליכטנשטיין ראש ישיבת גוש עציון, הרב יעקב אריאל רב העיר רמת גן, הרב יובל שרלו ראש ישיבת ההסדר בפתח תקווה, המשפטן פרופסור ידידיה שטרן, ויהודית שילת לשעבר סגנית יו"ר אמונה שייסדה את הפורום.

            

הכל נשאר במגזר

בשבוע שעבר פנתה מתלוננת לפורום וביקשה להישאר בעילום שם. היא ספרה את סיפור ההטרדה שהיתה לו קרבן אך סירבה להעיד בפני הוועדה המצומצמת של הפורום. לדברי שילת, היא נימקה את סירובה בפחד שבסופו של דבר גם היא תוכפש כפי שקרה בטיפולה של התקשורת והמשטרה במתלוננות נגד השר רמון והנשיא קצב. "למרות שמעולם לא נפגעה פרטיותה של מתלוננת בפורום, אישה זו חוששת להיחשף", מספרת שילת.

ביתר המקרים שבהם טיפל הפורום, לאחר פנייה ראשונית זומן המטריד לוועדה הבודקת. לאחר שהוצגו בפניו הנתונים, הוא התבקש לפעול בדרך שקבעה הוועדה. ככלל, הוועדה מגבילה את יכולת הפעולה של המטריד ומרחיקה אותו מעמדה או תפקיד שבהם הוא נמצא במגע עם הציבור. עד כה, איש לא הכחיש את המיוחס לו. "רובם אמרו שלא הובנו נכון, שזה לא היה מיני
וכדומה", מספרת שילת, "אך מעולם לא נאלצנו לממש את האיומים, כולם הבינו את המסר".

במקרה של הטרדה מינית מוזמנות המתלוננות לפנות לכל אחד מראשי המערכות החברים בפורום ובעיקר לארגוני הנשים, "קולך", "אמונה", ו"מרכז סיוע לנשים דתיות". בפורום מציינים כי נבדקו וטופלו גם תלונות של גברים שהוטרדו מינית.

בשונה מהטיפול המשטרתי במתלוננות על הטרדה מינית, בפורום זה, שמתעסק עם אישים בעלי סמכות ומרות בציבור הדתי, מדגישים כי הדיסקרטיות היא מוחלטת. היחידים שיודעים את הפרטים הם חברי הוועדה המצומצמת. "אנחנו לא באים לפעול במקום החוק", מציינת שילת, "אלא לעזור במקרה שנשים מסרבות בכל תוקף להגיש תלונה במשטרה ואיננו רוצים שהפוגע יוכל להשתמש במעמדו כדי להטריד או לנצל מינית את מי שנתון למרותו."

    
       

על פי חוק

הרב יובל שרלו הדגיש כי "הפורום הוקם רק למקרים בהם אין בהם עניין למשטרה שכן מדובר במקרים של סטייה מהנורמות הנוהגות בחינוך הדתי שאינן אסורות על פי חוק אלא על פי הכללים הפנימיים של הציבור הדתי, או למקרים בהם המשטרה אינה מטפלת בשל התיישנות, חוסר עניין לציבור או כל דבר אחר. כמובן שאין להסתיר דבר, ובוודאי שלא לומר שזהו חילול השם לחשוף עוולות. להפך, האמונה העמוקה שלנו בריבונו של עולם היא שאין לכסות על עוולות, אלא לבער את הרע מתוכנו ולא להסכים לכיבוס כביסה מלוכלכת בפנים".
